Terms of Service

Welcome to Velox. These Terms of Service ("Terms") govern your access to and use of the Velox application, the velox-running.com website, and related services (the "Service"), provided by Velox LLC ("Velox", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Your Account

To use certain features you must create an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at the contact address below if you suspect any unauthorized use of your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Reverse engineer, decompile, scrape, or otherwise attempt to extract the source code or underlying data of the Service, except where such restriction is prohibited by law;
• Interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure;
• Misrepresent your identity or impersonate any person or entity.

4. No Medical Advice

The Velox app is for informational and educational purposes only. It does not provide medical advice, diagnosis, or treatment. Always consult your physician or a qualified health provider before beginning any exercise program or making changes to your health regimen.

5. Assumption of Risk

By using the Service, you acknowledge and agree that physical activity involves inherent risks, including injury, illness, or death. You voluntarily assume full responsibility for any risks, known or unknown, associated with your use of the Service and its content.

6. No Guarantees

We do not guarantee that our recommendations will lead to any specific fitness or health outcome. All results vary based on individual conditions and effort.

7. User Responsibility

You are solely responsible for your health, actions, and any consequences that arise from following advice or plans provided in the Service.

8. Intellectual Property

The Service, including its software, design, text, graphics, and other content (excluding content you provide), is owned by Velox LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

9. User Content and Data

You retain ownership of the information and content you submit to the Service (such as survey responses, training data, data you allow the app to read from Apple Health, and data you allow us to receive from a Garmin Connect or COROS account you link). You grant Velox a worldwide, non-exclusive license to host, store, process, and use that content solely as necessary to operate and improve the Service.

Two specifics worth stating plainly. Messages you send to the in-app coach are stored for 12 months and used to improve how the coach answers questions; the coach's replies to you are not stored. Your training summary — including, for a run from Apple Health, Garmin or COROS, its start time, duration, average heart rate, and the intervals we detect in it with their distance, pace and heart rate — is sent to third-party AI models (Anthropic's Claude, on Amazon Web Services' Bedrock service) to generate coaching text. It is never used to train AI models. Linking a Garmin account includes your consent to this use, and disconnecting Garmin withdraws it. Both are described in detail in our Privacy Policy, which governs our handling of your personal data.

10. Leagues and Simulated Runners

Velox may offer leagues: optional, season-long groups of runners who see parts of each other's training data and compete against one another. Joining a league season requires the consent described in our Privacy Policy. You may leave a season at any time — in the app before it starts, or by contacting us once it is running; leaving a running season forfeits your remaining fixtures in it.

To fill a league out to between four and six members, we may add simulated runners that we operate, so that a league you join may include them. A simulated runner is not a real person. Its training log is generated from its own Velox plan rather than copied from anyone, and it takes part in the league's reads and scoring the same way a real member does. You are told when you join a season that a league may include simulated runners; the app does not mark which members are simulated.

When you log a run during a season, your opponent may be sent a notification that you have done so.

11. Third-Party Services

The Service relies on third-party providers, including Amazon Web Services (hosting, storage and AI models), Supabase (authentication), Anthropic (coaching text generation, via AWS), Apple (Sign in with Apple, Apple Health, push notifications and WeatherKit), Google (Sign in with Google, and Google Analytics on our website if you accept analytics cookies), Sentry (error monitoring), PostHog (product analytics) and GitHub (bug reports). If you link them, Garmin (through Garmin Connect) and COROS are sources of your data: they send it to us, and we send them only what is needed to fetch it and to end our access when you disconnect. If you connect an AI assistant — an app such as Claude or ChatGPT — to your account, it can read your training plan and run summaries and, on a co-coached plan, change your plan, as our Privacy Policy describes. You choose and approve each one, and it never receives Garmin data. Your use of those features may be subject to the third parties' own terms and privacy policies. We are not responsible for the content or practices of third-party services. The Privacy Policy describes what each one receives.

Garmin

Velox's Garmin integration is provided by Velox, not by Garmin. Garmin does not endorse Velox and is not responsible for the Service, for what the Service does with your Garmin data, or for any coaching, insight or plan the Service produces. Garmin makes no warranty to you about the Service. Your use of Garmin Connect remains subject to Garmin's own terms.

When you link a Garmin account, you agree to use the integration and the Garmin data it brings into Velox only for your own use of the Service. You agree not to:

• Link a Garmin account that is not yours, or use the integration to obtain anyone else's Garmin data;
• Copy, export, sell or pass on Garmin data you see in the Service, including another runner's, except as the Service itself allows;
• Interfere with, probe or overload the integration, or use it to reach Garmin's systems in any way the Service does not.

We may disconnect your Garmin account, or suspend your access to the Service, if you break these rules.

12. Reporting Abuse

To report abuse of the Service, including misuse of a device integration, another runner's data, or a league, email support@velox-running.com. Please include what happened and when, the usernames or league involved if any, and screenshots if you have them. Do not include anyone's password. We will look into every report, and may suspend accounts or disconnect integrations while we do.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

14. Disclaimer of Warranties

The Service and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

15. Limitation of Liability

To the fullest extent permitted by law, Velox, its creators, affiliates, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to injury, loss of use, data, or profits, arising out of or related to your use of the Service.

16. Indemnification

You agree to indemnify and hold harmless Velox LLC and its officers, members, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Iowa, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Iowa, except where prohibited by applicable law.

18. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date above. If we make a material change, we will also notify you in the app or by email before it takes effect. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
